Jacob Tracer

Jacob Tracer is the head of litigation at the Recording Industry Association of America (RIAA), where he advocates on behalf of the trade association’s members to protect their sound recordings from infringement and promote the human creativity embodied in those recordings to the public. He primarily manages cutting-edge, large-scale infringement lawsuits addressing a wide variety of issues facing the music industry today, including evolving forms of digital piracy and artificial intelligence. He also negotiates pre-litigation disputes on behalf of RIAA members, oversees the preparation of amicus briefs on issues important to the music community, and counsels member companies about how best to protect their copyrights in the modern marketplace. Jacob was previously a partner at Jenner & Block LLP, where he litigated cases on behalf of copyright holders and media entities of all types. While at Jenner & Block, Jacob was recognized by the National Law Journal in 2023 as an Intellectual Property Trailblazer.

“Toe 2 Toe”: The 2023-2024 Music Litigation “Paper Chase”

Even in the shadow of dozens of high-profile AI copyright lawsuits, music litigators have had a busy year. To be sure, one of the many new music copyright cases was brought by music publishers against AI company Anthropic. But many other cases have been winding their way through the federal courts, including fights over hip-hop lyrics; sampling and soundalikes; copyright grant termination; infringements on social media; and a potentially watershed case involving the embattled statute of limitations “discovery rule”. This panel will review the greatest hits of music copyright litigation over the last 12-18 months and provide updates on areas of the law that are critical to labels, publishers, and artists alike.
